Terms and conditions
**1. Definitions**
1.1. "Seller" refers to Conchobar Amplified Chocolate BV, a company registered in the Netherlands.
1.2. "Buyer" refers to any person, legal entity, or organization purchasing chocolate products through the Seller's webshop.
1.3. "Goods" refers to the chocolate products offered for sale on the webshop.
1.4. "Webshop" refers to the online platform through which the Seller offers and sells Goods.
1.5. "EU" refers to the European Union.
**2. Applicability**
2.1. These terms and conditions apply to all contracts, orders, and sales between the Seller and the Buyer concerning the sale of Goods through the webshop.
**3. Orders and Pricing**
3.1. The prices listed on the webshop are in Euros and include VAT.
3.2. Orders placed by the Buyer are subject to acceptance by the Seller. The Seller reserves the right to reject any order.
3.3. The Seller may modify prices and availability of Goods without notice, but such changes will not affect orders already placed.
**4. Payment**
4.1. Payment for Goods must be made by the Buyer at the time of the order through the payment methods provided on the webshop.
**5. Delivery**
5.1. The Seller will make reasonable efforts to deliver Goods within the EU within the time specified on the webshop. Delivery times may vary, and the Seller is not responsible for delays due to factors beyond their control.
5.2. The Buyer is responsible for providing accurate shipping information. If the Buyer provides incorrect or incomplete shipping information, resulting in failed delivery, the Buyer may be responsible for additional shipping charges.
5.3. Risk of loss or damage to the Goods passes to the Buyer upon delivery.
**6. Returns and Refunds (Food Products)**
6.1. Due to the nature of the Goods being food products, returns and refunds are not possible except in cases where the Goods are defective or the Seller made an error in the order.
6.2. If the Goods received are defective or there was an error in the order, the Buyer should contact the Seller within a reasonable time to arrange for a replacement or refund. In such cases, the Seller may require photographic evidence or other documentation to process the claim.
**7. Liability and Warranty**
7.1. The Seller is not liable for any indirect or consequential losses or damages.
7.2. The Seller provides a warranty on Goods as required by Dutch and EU law. Any defects or non-conformities should be reported to the Seller within a reasonable time.
**8. Data Protection and Privacy**
8.1. The Seller will collect, process, and store personal data of the Buyer in accordance with Dutch and EU data protection laws. For more details, please refer to the Privacy Policy on the webshop.
**9. Governing Law and Dispute Resolution**
9.1. These terms and conditions are governed by Dutch law.
9.2. Any disputes arising from or related to these terms and conditions will be subject to the exclusive jurisdiction of the Dutch courts.

10.1. These terms and conditions may be amended by the Seller at any time, and the most recent version will be posted on the webshop.
